Terms & Conditions

These Terms & Conditions applies to Customers’ use of the website located at www.linili.com (hereinafter referred to as “LINILI”, “Website”). By using and accessing LINILI, Customers are explicitly bound by the Terms & Conditions detailed in this or any other document currently accessible via www.linili.com. Customers are also bound by any supplementary conditions, which may be added or referred to in this document. If a Customer does not agree with these Terms & Conditions and/or any supplementary conditions, he or she should not access, use or view LINILI.

1. Offers, Orders and Payments 

1.1 All offers, propositions, proposals, discounts on the Website or anywhere else are optional and non-binding, unless stated otherwise in writing by LINILI.​​​

1.2 All prices on the Website, order confirmation and on any documentation or correspondence are in Euro and include applicable Value Added Tax (VAT).

1.3 We accept different payment methods provided by third party payment service providers. Please note that depending on Customer’s country of residence, some payment methods might not be available.

1.4 The Customer shall guarantee the accuracy and completeness of the information that is submitted to LINILI and on which LINILI bases its offer. We are not liable for any damages as a result of information provided by the Customer which is not complete and/or accurate.

1.5 LINILI reserves the right to not accept or cancel any offer for any reason at any time, for example, we are unable to obtain authorization for payment; the price listing was inaccurate; shipping restrictions apply to a particular item; the item ordered is out of stock or does not satisfy our quality control requirements; etc. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers and/or distributors.

1.6 If an order is not accepted or cancelled, LINILI will make sure to notify Customer by email and give, if possible, an option to place a new order for the correct price. If LINILI is unable to contact the Customer, the order will be automatically cancelled.

1.7 An order confirmation by LINILI is considered to be an accurate and complete representation of the order. If LINILI starts delivery of the item(s), or sends an invoice, these acts are considered to be of equal status as an order confirmation.

2. Delivery

2.1 LINILI delivers Worldwide, however, some jurisdictions might require additional efforts or can be more costly In case you have any doubts of delivery to your jurisdictions, please reach out to us via info@linili.com.

2.2 If a Customer orders more than one item or the item requires special shipping method or is of a bigger size, additional costs may apply. For actual delivery costs, please follow the information in the order confirmation page or contact us via info@linili.com.

2.3 LINILI will try, based on a best effort obligation, to dispatch the items within one (1) to five (5) business days from the order confirmation. Custom orders might take longer to make and dispatch.

2.4 If the item cannot be shipped in whole within a period of thirty (30) days from the estimated dispatch date, LINILI will notify the Customer and the Customer will have a right to terminate the order without any costs and without being liable to LINILI. After such termination LINILI will reimburse amounts already paid by the Customer in full, including delivery costs.

2.5 Orders will be delivered directly to the address provided by the Customer. LINILI will send item dispatch confirmation.

2.6 Any delivery date or term indicated or agreed by LINILI is determined by us based on our best knowledge and the information available at the moment of the order confirmation. A delivery date or period can vary and cannot be construed as a deadline, resulting in LINILI’s liability for any damages incurred by a Customer.

2.7 LINILI is not responsible for shipping delays and / or lost packages in instances where (i) the package was mishandled by the delivery service provider, customs or any other third party; (ii) the package was delayed / lost due to the incorrectly provided shipping address; (iii) the package delivery status is marked as “delivered” in the delivery service provider’s tracking system.

2.8 If the item is to be delivered to a country outside of the European Union, the Customer will be obliged to pay all import taxes, customs and/or intermediation charges, and provided that they are applicable – charges for the transportation or the distribution of the items listed in the order. The Customer is held responsible for the provision of all the information and the documents required by the customs or other authorities of such country for proper and effective delivery of the ordered item to the Customer. Such fees are not calculated and not indicated in the order confirmation page. LINILI recommends consulting local customs’ authorities regarding the final price of the item delivered to the country in question prior to completing the purchase. If the Customer refuses to pay abovementioned additional taxes and the order is sent back to LINILI, the Customer will  be reimbursed amounts already paid, excluding delivery costs and any other costs incurred by LINILI.

3. Cancellation, Returns and Refunds​

3.1 Customers are entitled to return or exchange the items within the period of 14 calendar days from the day of the receipt of the order and applicable to all purchases done via Website.

3.2 Only the items that were ordered directly from LINILI’s Website can be returned or exchanged following the steps described in these Terms & Conditions. Items purchased at any other retail store (either physical or online) must be returned to that store directly. LINILI is not liable for any purchases made via other retailers.

3.3 Replacements and/or returns are possible only if the items were not used, are not dirty, have not been custom made, the items’ original labels and all other packaging’ elements are not damaged and/or removed and sent back together. Customers are responsible for return shipping costs. If the item is not returned in its original condition, the Customer is responsible for any loss in value. LINILI will not accept late returns or returns if the mentioned requirements have not been fulfilled.

3.4 LINILI is not liable for incorrect use or care of the items by Customer or for use of the items for a purpose which the item is not suitable for. We will not accept returns if the item was already used, used incorrectly or not in accordance with its purpose.

3.5 In accordance with applicable Lithuanian legislation, the following items are not eligible for returns:

  • Cosmetics, perfumes and toiletries;

  • Underwear, lingerie, nightgowns, pajamas;

  • Socks, stockings and similar items;

  • Baby clothing items;

  • Bedding items;

  • Fabric samples;

  • Custom made items;

  • Items, that were taken out of their original packaging and cannot be returned due to health related and/or hygienic reasons;

3.6 Requests regarding returns or exchanges must be sent to LINILI via  info@linili.com. A receipt or any other proof of purchase must be sent together with the request.

3.7 Please note that the Customer is responsible for all the expenses related to the exchange or return of an item. All items must be returned to our specified address, which will be provided to the Customer with exchange or return confirmation.

3.8 Customers are responsible for the shipping of returned items back to us. LINILI takes no responsibility for any damage, destruction or loss of the item during its delivery back to us and no Customer’s losses and/or expenses will be covered. We recommend choosing the most reliable mode of shipment and ensuring that the item is sent back to us intact and on time.

3.9 Once the returned item is received and inspected by us, we will send an email informing about the rejection of the requested refund in case the item was used, dirty, have been custom made, the items’ original labels and all other packaging’ elements are damaged and/or removed, the item is not returned in its original condition or lost its value as set out in part 3.3. of these Terms & Conditions.

3.10 If the refund request is approved, the refund will be processed and the money is sent back by the original method of payment or to the bank account given by the Customer. LINILI is free to choose the refund method. Refunds for returned items will be made within fifteen (15) calendar days.

3.11 Any banking or payment processing expenses related to the refund as well as any other charges related to the return of the item, if any, shall be covered by the Customer.

3.12 LINILI will only exchange a non-faulty items for the same model if the item of the requested size and/or color is in stock. If the requested color or size is out of stock, we can then process a refund or exchange the item for another item on which we would agree on separately.

3.13 The shipping costs of the exchanged non-faulty item shall be covered by the Customer.

3.14 If the item is faulty, LINILI will replace the faulty item with the another item of the same model, size, and color at its own expense.

3.15 LINILI will dispatch the replacement within the period of one (1) to ten (10) business days from the receipt of the faulty item and of confirmation that the item is faulty, unless the Customer and LINILI agrees on a different replacement dispatch time. Replacement will be dispatched  only if the replaced item of the requested size and/or color is in stock.

3.16 If the faulty item cannot be replaced the Customer will receive a full refund of the direct damages not exceeding the sum of the order or part of the order from which the liability of LINILI derives from. The refund will be executed in terms described in part 3.10. of these Terms & Conditions.

4. Third-party Tools And Links

4.1 Certain content, products, and services available on LINILI’s Website may include materials from third-parties, e.g. payment services are provided by a third party.

4.2 Customers acknowledge and agree that LINILI provides access to such tools ‘as is’ and ‘as available’ without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to Customers’ use of third-party tools.

4.3 Any use of optional tools offered through the Website is entirely at Customers’ own risk and discretion, and Customers must ensure that they are familiar with and approve of the terms and conditions on which tools are provided by the relevant third-party provider(s).

4.4 Third-party links on this Website may direct Customers to their websites that are not affiliated with LINILI. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant, and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services offered by third-parties.

4.5 LINILI is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Customers must carefully review the third-party’s policies and practices and make sure they understand them before they engage in any transaction. Complaints, claims, concerns, or questions regarding third-party content, products and/or services should be directed to the third-party.

5. Personal Data

5.1 The use of Customers’ personal data is governed by LINILI’s Privacy Policy.

6. Errors And Inaccuracies

6.1 On rare occasions information on Website might contain typographical errors, inaccuracies or omissions that may relate to item descriptions, pricing, promotions, offers, item shipping charges, transit times and availability. LINILI reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without any prior notice.

7. Disclaimer Of Warranties

7.1 LINILI does not guarantee, represent or warrant that Customers’ use of our services and purchases via Website will be uninterrupted, timely, secure or error-free.

7.2 LINILI shall not be obliged to meet any obligations, including any guarantee obligation, and will not be liable for any damages, if it is prevented from meeting its obligations as a result of a force majeure event. Force majeure shall include the following: a situation of force majeure encountered by LINILI’s own suppliers, failure by secondary suppliers engaged by LINILI on the Customer’s instructions to duly meet their obligations, the defectiveness of items, hardware, software or materials provided by third parties that LINILI has been instructed to use by the Customer, government measures, electricity failure, faults affecting the internet, computer network or telecommunication facilities, war, workload, strike action, general transportation issues and the unavailability of one or more staff members. We will make sure to duly inform Customers about a force majeure event and how it might affect our obligations towards them.

7.3 LINILI on some occasions might remove any services or items offered for indefinite periods of time, cancel the service at any time, without providing Customers any notice.

7.4 By accessing the Website, Customers expressly agree that their use of, or inability to use, the service is at their sole risk.

8. Severability And Termination

8.1 In the event that any provision of these Terms & Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms & Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

8.2 The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms & Conditions for all purposes.

8.3 Any failure to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision.

9. Prohibited Uses Of The Website 

9.1 Any persons visiting and/or using the Website are prohibited from using it or its content:

a) for any unlawful purpose;

b) to solicit others to perform or participate in any unlawful acts;

c) to violate any international and/or local regulations, rules, laws, or local ordinances;

d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;

e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;

f) to submit false or misleading information;

g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Website or of any related website, other websites, or the Internet;

h) to collect or track the personal information of others;

i) to spam, phish, pharm, pretext, spider, crawl, or scrape;

j) for any obscene or immoral purpose; or

k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

9.2 LINILI reserves the right to terminate that person’s use of the Website or any related website for any abovementioned violation and/or prohibited use.

11. Changes Of Terms And Conditions

11.1 These Terms & Conditions were last updated on 2023 12 01.

11.2 LINILI reserves the right, at its sole discretion, to update, change or replace any part of these Terms & Conditions by posting updates and changes to the Website. It is Customers’ responsibility to check the Website periodically for any changes. Customers’ continued use of or access to the website or the services provided following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes in full.
